Le tribunal de Première Instance de Nuakchot a annulé le mariage d’une fillette de 13 ans avec un homme âgé de 50 ans et ayant des problèmes mentaux.
Les parents de la fillette Raya Mint Abdelghader, l’avaient offerte en mariage au début de 2013 en échange de 200.000 Ouguiyas (environ 500 euros).
En Mauritanie, selon la loi, le mariage est permis à partir de18 ans mais une dérogation permet à une femme de se marier à partir de 16 ans. La présidente de l’AFCF (association qui cherchent à améliorer la condition des femmes en Mauritanie) assure que dans un pays où la quasi-totalité de la population pratique un islam conservateur, l’interdiction du mariage de mineures parait difficile .
En 2012, la justice mauritanienne a été confrontée à 9 cas de mineures mariées avec des hommes majeurs mais seuls les mariages de deux fillettes avec des époux de plus de 80 ans ont été annulés.
Selon les statistiques de l’AFCF, en 2012, environ 500 mineures âgées entre 9 et 16 ans ont contracté mariage et en 2013 le chiffre a encore augmenté de 54%.
Les raisons pour lesquelles les parents marient leurs fillettes sont essentiellement la pauvreté. Mais aussi dans le cas où les filles sont enceintes après un viol, celui-ci étant socialement considéré comme « un déshonneur » pour la famille.
L’AFCF remarque qu’en 2012, la Mauritanie a officiellement enregistré 4.732 cas de viols.
