Très discrètement, l’Assemblée Nationale a voté la prolongation jusqu’au 1er avril 2021 du régime transitoire d’état d’urgence décrété sous prétexte d’épidémie de Covid-19. Cet état d’urgence devait se terminer au 31 octobre 2020.
A l’issue de sept heures d’échanges tendus dans un hémicycle quasi désert, une majorité des rares députés présents a adopté en première lecture, dans la nuit de jeudi à vendredi, ce projet de loi de prorogation par 26 voix pour, 17 contre et 3 abstentions. Il doit encore être examiné par le Sénat.
Le gouvernement et les préfets devraient donc conserver pendant encore plusieurs mois la possibilité de prendre toutes sortes de mesures arbitraires et de limiter considérablement la marge de manœuvre de toute véritable opposition.
« Personne ne peut prétendre que le droit commun suffira et que l’épidémie est terminée », a justifié à la tribune Alice Thourot (LREM), rapporteuse du texte.
Eric Coquerel, député La France insoumise, a dénoncé un « état d’urgence permanent ».
« Nous ne pouvons pas accepter de laisser les clés au gouvernement pendant six mois encore sans contrôle régulier du Parlement. Concilier impératifs de santé publique et libertés publiques est indispensable. C’est un enjeu de démocratie ! », a pour sa part déclaré le député LR Phillipe Gosselin.
Face au Covid-19, « nous devons accepter de restreindre certaines de nos libertés auxquelles nous sommes attachés », argumente le ministre de la Santé, Olivier Véran.
