Un duo homosexuel croate “s’unit” civilement puis demande au centre d’assistance sociale de Zagreb la garde d’un mineur. Le Centre refuse car la loi interdit la garde par des couples homosexuels. Le duo va donc au tribunal et le juge donne raison au couple. Mais le Centre résiste, alors intervient la Cour constitutionnelle qui confirme la décision du juge ordinaire et déclare également que la loi sur la garde contient « une discrimination constitutionnellement inacceptable ». Ainsi, à l’avenir, les juges devront interpréter cette loi conformément aux principes exprimés par la Cour.
Cette affaire croate nous fait comprendre que “l’homoparentalité” est devenue un phénomène mondialisé et que les dynamiques pour légitimer des soi-disant « familles » se ressemblent d’un pays à l’autre : des sentences judiciaires gay friendly au Parlement qui doit s’adapter à ces sentences et à une pratique jurisprudentielle en contraste avec la législation. Et ainsi avance mondialement la révolution arc-en-ciel en marche…
