En 2006, le Tennessee avait au contraire approuvé par une très forte majorité (81,3% des votants) un amendement constitutionnel protégeant le vrai mariage. En 2012, une trentaine d’Etats des Etats-Unis avaient fait de même.
Dans son argumentation, la résolution précise que la décision « Obergefell versus Hodges » pose « de graves problèmes constitutionnels par rapport aux doctrines constitutionnelles du fédéralisme et de la séparation des pouvoirs », c’est à dire vis-à-vis du respect des droits des Etats fédérés des Etats-Unis. En conséquence, la résolution exprime son désaccord avec l’analyse constitutionnelle de la Cour suprême des Etats-Unis et remarque aussi que la décision de cette dernière est contraire à la volonté expressément affirmée aussi bien par la Chambre des représentants du Tennessee que par le peuple du Tennessee.
Espérons maintenant que le Tennessee prenne des lois ou/et règlements protégeant, notamment du point de vue juridique, les officiers d’Etat civil qui refuseront de faire les faux « mariages » qu’a prétendu autorisé la Cour suprême des Etats-Unis, trahissant ainsi le bien commun de ce pays.
