Deux cas ont été portés devant la Cour européenne des droits de l’homme dans l’espoir de faire reconnaître l’euthanasie en Grande-Bretagne comme un droit fondamental. Ces deux cas ont été rejetés. Le premier cas est celui d’un entrepreneur en construction du nom de Paul Lamb et le second celui d’un dénommé Tony Niclklinson décédé il y a deux ans. C’est sa veuve qui à l’époque avait diligenté ce recours auprès la Commission européenne de Strasbourg.
Mais dans son jugement écrit publié le jeudi 16 juillet, cette instance judiciaire a déclaré : « Dans le cas de Nicklinson et Lamb versus le Royaume-Uni, la Cour européenne des droits de l’homme a déclaré à l’unanimité les requêtes irrecevables. La décision est définitive. » Ce jugement paraît tout à fait extraordinaire car il va à l’encontre de celui du cas de Vincent Lambert. Il bloque une tentative de deux sœurs qui viennent de rassembler 8.000 £ pour faire euthanasier leur mère en Suisse.
Quoiqu’il en soit la Cour a estimé aussi que la Grande-Bretagne était tout à fait compétente pour juger des cas de cette nature. Ceci dans la mesure où le 15 juin précisément la Cour Suprême britannique avait elle-même émis un jugement négatif dans ces deux affaires.
Le porte-parole M. Kevin Fitzpatrick avait déclaré : « L’euthanasie et le suicide assistés sont particulièrement dangereux et inconvenant dans des cas aussi difficiles ; ils posent un risque grave que des milliers d’handicapés soient éliminés par les services de santé et la société ; une telle démarche fera penser que mieux vaut la mort que prolonger un fardeau pour la famille et les amis« .
