Aux États-Unis, comme dans beaucoup de pays du monde, se développe une offensive contre le mariage traditionnel. En son temps George Bush avait eu l’intention de modifier la Constitution pour y inscrire que le mariage ne pouvait concerner qu’un homme et une femme. Il n’eut pas l’opportunité de faire aboutir ce projet. C’est dommage car il en résulte actuellement un véritable chaos sur le sujet.
La Cour Suprême dans l’état actuel des choses a validé un certain nombre de cas particuliers de mariés de même sexe. Mais jamais elle ne s’est prononcé sur la constitutionnalité du mariage homosexuel. Elle a laissé chaque État de l’Union décider par lui-même.
Cette affaire est un véritable bourbier car dans tous les États qui ont validé ce type d’union, des recours ont été faits en Justice par les opposants. Les décisions prises par les tribunaux étaient alors souvent contradictoires. 17 États ont voté des lois protégeant le mariage traditionnel. Menés par le Colorado, ils ont demandé à la Cour Suprême de renverser les décisions juridiques prises par l’Oklahoma et l’Utah favorables au mariage gay. 15 autres États ayant voté des lois y étant favorables, en plus de ces deux cas précis, a été ajouté celui de la Virginie pour lequel le mariage gay a été annulé par la Cour de Justice fédérale. D’autres enfin ont demandé à la Cour Suprême la légalisation générale de ce type d’union. Dans cet embrouillamini, il y a même des États qui ont autorisé le mariage gay pour quelques heures ou quelques jours. Un comble…
La Cour suprême est actuellement en vacances, mais se réunira 6 octobre. Elle devra répondre à la question posée concernant les trois États cités ci-dessus. Peut-on légaliser le « mariage gay » ? Quelle que soit la réponse, quel sera le statut des duos homosexuels mariés dans d’autres États qui reconnaissent ce type d’unions ?
Dans tous les cas les réponses données auront un retentissement international. Encore que sur ce sujet de nombreux Etats ont déjà signalé qu’ils n’avaient rien à faire des décisions de l’Amérique décadente.
