Alors que le gouvernement français veut légaliser la PMA et que plusieurs parlementaires de La République En Marche évoquent déjà ouvertement leur intention de réclamer ensuite la légalisation de la GPA, il n’est pas inutile de rappeler les imbroglios juridiques auxquels ces situations conduisent. Aux Etats-Unis, il est déjà arrivé à plusieurs reprises qu’un duo de lesbiennes poursuive en justice le donneur de sperme pour payer une pension alimentaire.
Un article du journal britannique The Sun évoquait ainsi ce « couple de lesbiennes féministes », à savoir Tasha et Jose, qui a poursuivi un donneur de sperme pour payer une pension alimentaire pour son bébé.
Ces deux lesbiennes qui ont décidé de recourir à un artifice pour commander un enfant sans père ont soutenu ensuite que, puisqu’il est le père biologique de leur enfant, le donneur de sperme devrait tout de même verser une aide financière pour assurer le bien-être de cet enfant.
