Bolivie – Le gouvernement de ce pays est actuellement dirigé par Evo Morales, un amérindien arrivé au pouvoir grâce aux socialistes et contre la droite libérale. Deux comités des Nations Unies avaient fait pression sur les instances dirigeantes afin que l’avortement soit dépénalisé. Malgré les rejets successifs par l’Assemblée Générale onusienne de la notion de « droit à l’avortement », un certain nombre d’organismes comme l’UNICEF ou l’UNFPA (Fonds des Nations unies pour la population) font pression en permanence sur les pays les plus pauvres en les menaçant de les couper de l’aide internationale s’ils ne légalisent pas l’avortement. A ce jour des pays comme les Philippines ont vaillamment résisté ; mais aussi la quasi-totalité des pays d’Amérique du Sud à l’exception de l’Etat de Mexico au Mexique, la Colombie et l’Argentine; et aussi toute l’Afrique à l’exception de l’Afrique du Sud (par Mandela).

Le lobby avorteur avait lancé une offensive très médiatisée en disant qu’il s’adresserait à la Cour Internationale des Droits de l’Homme si le pays ne suivait pas les recommandations des organismes onusiens. Contre toute attente la Cour constitutionnelle, la plus grande instance judiciaire de la Bolivie a confirmé les lois du pays protégeant l’enfant non-né à l’exception des cas de viol. Toutefois doit intervenir alors une décision judiciaire ce qui a été considéré en pratique comme une forme d’impunité pour les violeurs et les trafiquants du sexe. En revanche il a donné son feu vert concernant les manipulations embryonnaires ; car selon la Cour, la vie humaine ne commence pas à la fécondation mais à l’implantation embryonnaire dans la cavité utérine. Ceci a été considéré par certains comme une forme d’ouverture à l’avortement.

Que s’est-il passé ? Il apparaît que le président Morales tient une position très ferme sur le sujet ce qui a pesé très lourdement dans le débat. Il avait déclaré il y a un an : « Tout avortement est un crime ». De plus 80 % des Boliviens sont opposés à l’avortement.

Le Cour constitutionnelle théoriquement indépendante a expliqué sa décision de manière étonnante. Les croyances autochtones amérindiennes quant à l’évolution du cosmos, estiment que la vie est une sorte de continuum perpétuel sans commencement ni fin. Il en résulte que tout ce qui concerne la vie et ce qui la génère doit être protégé. L’avortement est une rupture dans cette évolution.
