Boycotter les produits en provenance d’Israël est légal. La Cour de cassation a reconnu ce mardi 19 novembre la légalité de la campagne BDS (Boycott, Désinvestissement, Sanctions) dont les militants ont été régulièrement poursuivis devant les tribunaux par des organisations pro-israéliennes basées en France.
La plus haute juridiction française a rejeté les pourvois introduits par le Bureau national de vigilance contre l’antisémitisme (BNVCA) et la Chambre de Commerce France-Israël contre Olivia Zémor, présidente d’EuroPalestine. Poursuivie pour avoir diffusé la vidéo d’une action dans l’hypermarché Carrefour d’Évry (Essonne) en 2009, elle avait été relaxée en 2011 puis en appel en 2012. La Cour de cassation a confirmé cette relaxe.
A l’annonce de ce verdict, la campagne BDS France s’est réjouit « de cette nouvelle victoire juridique et appelle tous les citoyens de conscience à boycotter Israël, ses produits et ses institutions tant que ce pays ne respectera pas le droit international et les droits légitimes des palestiniens, et puisque nos gouvernements ne prennent pas leurs responsabilités », rappelant la visite qu’elle juge « scandaleuse » de François Hollande en Israël.
Elle appelle également la ministre de la Justice, Christiane Taubira, à abroger la circulaire Alliot-Marie datant de 2010 qui incite la justice française à poursuivre tout militant appelant au boycott d’Israël. Une pétition en ligne, lancée par le Collectif National pour une Paix Juste et durable entre Israéliens et Palestiniens (CNPJDPI), a d’ores et déjà recueilli plus de 3 000 signatures.
