C’est une décision importante. La Cour de cassation a annulé ce mardi 9 janvier la condamnation pour incitation à la haine qui avait frappé Christine Boutin, ancienne présidente du Parti chrétien démocrate (PCD), pour avoir déclaré que « l’homosexualité est une abomination » dans une interview à la revue Charles, en avril 2014. Les juges ont estimé que le propos était « outrageant » mais ne constituait pas une « exhortation à la haine ou à la violence à l’égard des personnes homosexuelles ».
« Je suis très déçu de cette décision car elle affirme qu’on peut libérer une parole homophobe très présente en France », s’est lamenté Me Etienne Deshoulières, avocat de LGBT Mousse.
