Alors qu’en France, l’affaire du viol d’une jeune capverdienne de 11 ans par un autre capverdien âgé de 28 ans, a défrayé la chronique car la justice l’a considérée comme consentante, la même affaire se reproduit en Finlande.
On apprend en effet que le 27 novembre, un dénommé Juusuf Muhamed Abbud, 23 ans, a été condamné à 3 ans de prison pour une agression sexuelle contre une enfant de 10 ans en 2016 dans la province de Pirkanmaa (capitale, Tampere). Le procureur du district avait demandé qu’il soit puni pour viol, donc que la peine soit de 10 ans, avis partagé par l’avocat de la victime. Mais, en Finlande comme en France, le fait d’être allochtone permet une clémence judiciaire de principe comme le prônait le Syndicat de la Magistrature. La cour d’appel du district est parvenue à la même conclusion que le tribunal de district de Pirkanmaa : les preuves n’étaient pas suffisantes pour démontrer que la victime, âgée de 10 ans, avait eu une relation sexuelle non consentie avec Abbud. Le viol aggravé n’a pas été retenu par les juges et ce, alors que la fillette ne pouvait pas se défendre à cause de ses pleurs.
« Mais celui qui scandalisera un de ces petits qui croient en moi, il vaudrait mieux pour lui qu’on lui attachât au cou la meule qu’un âne tourne, et qu’on le précipitât au fond de la mer » (Saint Matthieu, XVIIII-6).
