Léon Mugesera, est un ancien responsable du parti du président assassiné Juvénal Habyarimana qui avait fuit au Canada et avait été extradé en 2012 au Rwanda. Selon le juge Antoine Muhima : « La Cour estime que M. Mugesera est coupable. Il est un complice de ceux qui ont commis le génocide car il a directement incité à commettre le génocide et la torture constitutive de crime contre l’humanité, et incité à la haine ethnique ».
Il lui de plus reproché d’avoir fait en 1992 un discours anti-tutsi à l’occasion d’un rassemblement de son parti à l’ouest du Rwanda, un discours selon les juges, ayant des éléments qui avaient amorcé le génocide dans lequel il traitait les tutsi de « cafards » et encourageait les Hutus, ethnie à laquelle il appartient, de les tuer. Durant tout son procès il a nié les faits pour lesquels il était accusé.
A titre de rappel, le Rwanda compte trois ethnies dont les Hutus, les tutsis et les batswa qui sont très minoritaires. En 1994 avait éclaté une des plus grandes tragédies de l’humanité à savoir le génocide dont le point de départ fut le bombardement de l’avion du président hutu Juvénal Habyarimana.
