La photo d’un légionnaire français avec un foulard de tête de mort durant l’opération Serval, en janvier dernier, avait circulé dans de nombreux médias et sur internet au point de créer une polémique. Le légionnaire ne s’en est pas remis. Il a déserté la Légion en juin, s’est cloîtré chez lui à Orange depuis, alternant absorption massive d’alcool et de cachets. Mercredi dernier, il a pris sa kalachnikov démilitarisée pour aller demander des médicaments à la pharmacie. Interpellé chez lui peu de temps après, ivre mort, il dit ne se souvenir de rien. Présenté vendredi après-midi en comparution immédiate devant le tribunal correctionnel de Carpentras, il a été condamné à trois ans de prison avec sursis.
Selon l’état-major de l’Armée de Terre, il avait été sanctionné pour le port de ce foulard. Mais le légionnaire avait été maintenu au Mali pour terminer sa mission et avait regagné la France mi-février avec sa compagnie. Après ses permissions normales, l’homme a déserté une première fois, avant de rejoindre de lui-même son unité avec une vingtaine de jours d’absence non justifiée. Mi-juin, il avait déserté une deuxième fois et l’armée était depuis sans nouvelles de lui. Il a donc été exclu de l’armée. Selon le porte-parole de l’état-major, le colonel Louisfert : «Les éléments dont nous disposons ne nous permettent pas d’établir un lien de cause à effet entre l’affaire du Mali et la suite. » Selon lui, les sanctions prononcées en janvier avaient surtout des « conséquences administratives », comme une inscription au dossier. A son retour du Mali, il avait subi les tests habituels pour repérer un éventuel stress post-traumatique et il n’avait pas fait l’objet de détection particulière.
On peut difficilement ne pas voir une relation de cause à effet car tous les symptômes sont là. Tout cela est bien triste. Ce légionnaire, qui pensait avoir signé pour risquer sa vie, au final s’est trouvé victime du torrent médiatique pour un simple foulard représentant une tête de mort. Espérons que la grande famille de la Légion ne le laissera pas tomber et l’aidera à guérir et à se réinsérer.
